The present agreement regulates the general purchase conditions of the various services offered on the present website by SOCIETE D'EXPLOITATION DE LA CITE INTERNATIONALE DE LA GASTRONOMIE DE LYON (hereinafter LA CITÉ) with NIF (tax identification number) nº FR57841555428 and registered office at Grand Cloitre du Grand Hôtel Dieu n° 4, (69002) Lyon (Auvergne-Rhône-Alpes, France).

The CUSTOMER, at the moment in which they complete the registration process and purchase any of our services, accepts and expressly submits to the clauses specified below, as well as to the terms and conditions of access and use of our web portal and its privacy policy, accessible at the link “Legal Notice”.

The CUSTOMER confirms that they have the sufficient legal capacity to enter into contractual obligation.

The present contract is permanently accessible on the legal notices of our website.

1. PRICES AND TAXES

In exchange for the service acquired, the CUSTOMER expressly accepts to pay to LA CITÉ, the amounts specified on the price list established on the website https://citegastronomielyon.fr/en at time of purchase for the services selected.

The services offered on this website are subject to TVA (Taxe sur la Valeur Ajoutée) [VAT (Value Added Tax)] which IS INCLUDED in the prices specified for each service.

Once the selection of services is complete, prior to confirmation of the order and before proceeding to payment of it, the final price of the purchase will appear on the screen, and will include the VAT (Value Added Tax) and the management, packaging and shipping costs, if applicable, which will be reflected on the order form at time of making the purchase, and on the invoice.

Anything which does not appear specified in the description as included, is not included.

2. PURCHASE PROCEDURE

Orders may only be placed on this website by natural persons aged 14 years and over, and by companies.

All our services are described individually on the website. The procedure to make and manage the purchase is shown on the web page, and all that is required is to follow the steps below:

a. Choose the service that you wish to acquire.

b. When you select the service, you will be able to add it to the Shopping Basket, and you will be able to choose between continue shopping and processing the order.

c. To process the order, if it is the first time you access our portal, you will need to fill in a registration form with your personal details, and create a personal account as user. Once you have completed this step, you will receive the confirmation that the registration has been carried out correctly at the email address you have indicated. If you are already a registered user, all you will need to do to continue the purchasing process is to enter the user name and password which were generated with your first purchase. The user code and password are personal and correspond to the person who carried out the registration process, who is solely responsible for their safekeeping. Through your account, you will be able to manage the information we have and alter or update your details.

d. You will then proceed to the order verification, where the articles selected will be specified one by one, and the total price is calculated.

e. You will also need to give a billing address for the purchase made.

f. Once the process is complete, you will need to mark a box beforehand to confirm that you have read and accepted the terms and conditions of sale.

g. The mechanisms with which to make the payment will be provided on the web page in accordance with the system chosen in each case.

h. Once you have entered the payment details, confirm the order by pressing the button “Buy”.

i. Once you have pressed the “Buy” button, the entry for the service you have requested will be put at your disposal by following the instructions that appear.

The CUSTOMER acknowledges that they have been informed that the photographs and descriptions of the services on the website are an approximate image of the services offered, which means that they may differ from the original. The descriptions and illustrations of the services offered through the present website are given as a guideline only.

3. AVAILABILITY AND DELIVERY

The services offered by LA CITÉ are available for sale anywhere in the world.

The orders will be processed once the payment has been received correctly.

So that you remain informed of the management of your purchase at all times, you will receive a notification of the confirmation of your order and of the payment, by email.

4. PAYMENT AND PAYMENT PERIODS

The following means of payment are accepted:

- Credit and Debit card: The transaction is carried out by connecting directly with the banking institution CREDIT AGRICOLE through its payment gateway.

Once the payment has been made, you will receive an email confirming the same.

LA CITÉ will have no knowledge of your credit card details. All our payment systems are completely secure.

The payments are previous to the service provision, which means that LA CITÉ will not provide the service until the payment for it has been received. LA CITÉ reserves the right to cancel the services provided temporarily or permanently in the event of any incident relating to the charging of them.

5. INVOICES

Upon making the corresponding payment, you will receive the Invoice for your purchase in PDF format at the email address you have indicated for this purpose when processing the order.

If you wish to obtain an invoice in the name of your company, please contact customer services (contact@citegastronomielyon.fr) to provide the necessary tax details.

The CUSTOMER is responsible for confirming the receipt of notifications and for informing us of any change to their details, and LA CITÉ is exempt from any responsibility derived from this circumstance.

6. GUARANTEE

At LA CITÉ, we strive to provide top quality services, although, given the nature of these services, we cannot give a guarantee of satisfaction. In the event that you do not receive the service correctly, for any reason, please communicate this to us as soon as possible indicating the incident, and, if the error is verified, we will attempt to rectify it as quickly as possible.

7. RETURNS

Given the nature of the service object of the present contract, it is not possible to make returns.

8. RIGHT OF WITHDRAWAL

Due to the nature of the service (recreational activities on a specific date or with a specific execution period), and in accordance with Article 103, Point I of Legislative Royal Decree 1/2007, of 16 November, on the Defence of Consumers and Users, the right of withdrawal is not applicable to this contract.

9. CONCLUSION OF THE CONTRACT AND MODIFICATIONS TO THE SERVICES

The present contract shall be concluded upon payment of the service and the sending of a confirmation email to the CUSTOMER with a description of the purchase made.

LA CITÉ reserves the right to modify the characteristics and conditions of its services in any way, provided that the objective is to improve them and provides a benefit to the CUSTOMER.

10. OBLIGATIONS OF THE PARTIES

LA CITÉ commits to providing the CUSTOMER with the services which have been contracted, applying maximum diligence in service provision, as well as to take care of the maintenance of the facilities necessary for the functioning of the network, having at its disposal a suitable technical and ICT team for this purpose.

The CUSTOMER commits to using the services put at their disposal in good faith, without violating the laws in force in any matter or infringing the rights of third persons, as well as to the payment of the service selected in the time and manner established in the present sales conditions.

LA CITÉ does not guarantee that the availability of the service object of this contract will be continuous and uninterrupted, whether due to circumstances caused by Internet network problems, breakdowns in the computer devices and other unpredictable circumstances. As such, the CUSTOMER accepts to tolerate these circumstances within reasonable limits and expressly renounces the possibility of making claims against LA CITÉ for any contractual or extra-contractual responsibility due to the possible faults, errors and use of the service contracted.

11. COMMUNICATIONS

All notifications between the parties shall be sent preferentially by email. The CUSTOMER is responsible for confirming the receipt of notifications and for informing LA CITÉ of any change to their details, and LA CITÉ is exempt from any responsibility derived from this circumstance. In the event of modification, the CUSTOMER must inform LA CITÉ at the email address or telephone number indicated on our website.

In accordance with Article 21 of Law 34/2002 on Information Society Services and Electronic Trade, we hereby inform you that our commercial mailings and information concerning our website and the services offered on it are sent by email to the email address you provide to us, and are always revocable. In any case, you have the option of rejecting our commercial communications by sending an email to the email addresscontact@citegastronomielyon.fr indicating the word “UNSUBSCRIBE” in the subject line.

12. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

The CUSTOMER acknowledges that they have read and accepted the legal conditions of use and the privacy policy of the website.

The CUSTOMER affirms that they have understood all the information concerning the services offered on our website, as well as all the conditions and stipulations gathered in the present electronic contract, and as such states that they are sufficient for the exclusion of error in the consent to the present contract, and therefore accepts them expressly and in full.

The CUSTOMER is fully aware that the acceptance and execution of the present contract will take place through the provision of their details and when they press the button “Buy” indicated on our website, and that the contract will be concluded upon payment of the service.

13. APPLICATION LEGISLATION

This is a commercial contract and shall be governed and interpreted in accordance with Spanish law.

Unless an imperative jurisdiction exists, the Parties shall submit to the courts and/or tribunals of Lyon.
